Terms of Service

1. Who we are

IntelliPest (the "Service") is operated by Bug Stoppers Pest Control("Bug Stoppers", "we", "us", or "our"). By accessing or using the Service, you enter into a legally binding agreement with Bug Stoppers Pest Control.

2. Acceptance of terms

By creating an account, accessing, or continuing to use IntelliPest, you agree to be bound by these Terms of Service and our Privacy Notice. If you do not agree, do not use the Service. You represent that you are of legal age to form a binding contract and, if using on behalf of an organization, that you have authority to bind it.

3. The Service

IntelliPest is an AI-powered pest identification tool that helps users recognize household and yard pests from photos or descriptions and provides general guidance, including when to consult a professional. The Service may recommend Bug Stoppers Pest Control for hands-on treatment where appropriate.

4. Accounts and credentials

You must provide accurate, current information when creating an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable law.
• Engage in fraud, spam, or abuse of the Service or its users.
• Infringe any intellectual property, privacy, or other rights.
• Interfere with the security of the Service, including probing, scanning, reverse engineering, distributing malware, scraping, or circumventing rate limits or access controls.
• Resell, redistribute, or sublicense the Service.

6. AI-generated content and acceptable AI use

IntelliPest uses generative artificial intelligence to produce pest identifications, reports, and guidance ("AI Outputs"). You acknowledge and agree:

• You are responsible for the prompts, photos, and other inputs you provide, for verifying the accuracy of AI Outputs, and for the decisions you make based on them.
• You must have all necessary rights to any content you submit and must not upload content that is illegal, infringes third-party rights, or depicts people without their consent.
• You must not use the Service to generate illegal content, hate speech, harassment, deepfakes, malware, or to attempt to jailbreak, exploit, or bypass safety measures of the underlying AI models.
• AI Outputs may be inaccurate or incomplete. IntelliPest is a general information tool and is not a substitute for professional pest control, medical, veterinary, legal, or other regulated advice. Do not rely on AI Outputs for decisions that require licensed professional oversight — confirm with a qualified professional.

7. Content moderation

We may filter, restrict, or refuse AI Outputs; remove or block content that violates these terms; and suspend accounts that misuse the Service. If you believe an AI Output infringes your intellectual property rights, contact us at info@bugstopperspestcontrol.net with sufficient detail to identify the content and your rights. We may terminate accounts of repeat infringers.

8. Intellectual property

The Service, including its software, models, prompts, branding, and documentation, is owned by Bug Stoppers Pest Control or its licensors and is protected by applicable intellectual property laws. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business use within your selected plan.

You retain rights to the content you submit ("User Content"). You grant us a limited license to host, process, and use User Content solely to provide, secure, and improve the Service.

9. Payment, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy. Subscriptions renew automatically until canceled; you can cancel at any time and will retain access through the end of your current billing period.

10. Service availability

We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time. Features may change, and we may add, modify, or discontinue functionality at our discretion.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Bug Stoppers Pest Control shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service. Our aggregate liability for any claim arising from or relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) USD $50. Nothing in these terms excludes liability that cannot be excluded by law (such as fraud, death, or personal injury caused by our negligence).

13. Indemnification

You agree to indemnify and hold harmless Bug Stoppers Pest Control from any claims, damages, or expenses arising from (a) your User Content, (b) your use of the Service in violation of these terms or applicable law, or (c) your violation of any third-party rights.

14. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. Upon termination, sections that by their nature should survive (including IP, disclaimers, limitations of liability, and indemnity) will survive.

15. Governing law

These terms are governed by the laws of the State in which Bug Stoppers Pest Control is established, without regard to conflict-of-laws rules. Disputes shall be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise.

16. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, through the Service. Continued use after changes take effect constitutes acceptance.
